AFP Management, Guild Sign Half-Million Dollar Grievance Settlement Over Subcontracting

Agence France-Press employees will share in a settlement totaling approximately $500,000 after the Guild and AFP resolved a subcontracting grievance.

The agreement was signed May 4th as the case was due to go to arbitration.

All AFP Guild-covered employees will get a two-week bonus upon signing of the agreement and another two-week bonus in January. Those payments will total more than $400,000.

The agreement also includes increased sales commissions (a sales bonus plan was implemented earlier as a direct result of the grievance); payments of $2,000 to each photo department employee; and job guarantees.

The settlement followed months of sometimes contentious negotiations and an apparent settlement that AFP pulled out of in January.

The dispute stemmed from AFP’s decision last year to have Getty Images take over much of its domestic photo operation, leading to a net loss of six photo department positions (positions were eliminated through attrition and voluntary transfers). The Getty-AFP deal also barred AFP Guild-covered sales employees from selling AFP photos to North American media.

As part of the settlement of the Getty arbitration and the earlier settlement of a related grievance, at least two jobs have been or will be restored and a third could be placed in the unit. In addition, all photo and marketing department jobs and positions are guaranteed through 2006. AFP also agreed to a list of photo assignments that must be staffed by AFP photographers.

Finally, AFP agreed that the Getty arrangement could not be cited as past practice or precedent in subcontracting.

AFP Unit Chair Rob Lever, Local Representative Paul Reilly and TNG General Counsel Barbara Camens handled the settlement talks for the Guild.
